The real question probably is not who can know of a list's existence
(public vs.  private) but who can send to the list (Send=, maybe Editor=).
Instead of taking a list bothered by pests private, you might consider
making it a moderated list for a while.  It's a nuisance, but it might be
easier on your users.  You'd have to bless every submission to the list,
but that lets you keep the pests out while letting everyone one else in.
Hopefully it'd only be a temporary measure until the pests go away.
 
If there's an associated newsgroup, you'd have to make that a moderated
newsgroup, which can be a pain.
 
If you also take the pests off the subscription list and make subscriptions
by owner, then you could allow everyone on the list send without
intervention and moderate submissions from people not on the list.
(editor= atgvg@asuacad,(mylist-l) is the syntax for the list header.)
