no. common usages are not subject to such control.

common usages of trade names are even protected to
some extent. (kleenex, coke, crayon, ie: the use of
any of these words is not normally actionable by the
trademark holders, unless used in an advertising
campaign, and even then, if proper attibution is
included, is not actionable. only using them as the
trade name of a competing product is actionable.)

he might be able to get a mechanical license on a
specific "rendition". (such as arno's "I'll be back".)

he can't get author or publisher rights on the phrase.

if somehow he does, i'm going for "f**k you"... a
phrase that is often "actionable" in it's own right...
