Unanimous ruling that the (private) organizers of Boston's St. Patrick's
Day Parade have the right to include/exclude anyone they choose (in
response to a suit brought by a Gay Rights group). The Court took the
position that free speech was not impeded because any excluded group could
get a parade permit and organize their own parade.
Because there are now a variety of software packages (some shareware, some
commercial) for running lists on one's workstation, anyone excluded by a
list owner can create their own list (or find a different list). I
actually know of a specific case of a list that exists because of a
subscriber's frustration with the policies of the editor of a moderated
list.
