I'm sure I don't understand all the ins and outs of this scenario, but
it seems to me that this individual is NOT sending mail to the list
(SEND=PRIVATE), but individuals who also happen to be ON THE LIST, and
who's messages he has (IN)DIRECTLY received from them.
 
So IF this is a case of e-mail harassment (and you/they will have to
figure out IF those correspondences and correspondents qualify), then
the sysadmins of those systems should be contacted.
