Moderate as in the moderation queue in the web interface or moderate as in approve the message via an email OK link before it is sent out?

We had a spam fix here that placed a lot of our confirmation emails into junk spam folders.

If you take the ,confirm off the list can the owner send then?

which could cause such?  Owners are not generally moderated, but they may be a default monerator.
