David;

You're treading on dangerous territory. Do not get burned. Seek the advise
of legal counsel with regard to this issue. This topic goes beyond the
scope of this list in my humble opinion.

I know of what I speak because I have had two incidents on lists that I
host, which rose to the level where threats were made to our legal
counsel. Fortunately, I am friendly with the attorney who handles such
things here so I was able to smooth things out fairly quickly, but one
incident ended up causing the list's owner to throw up her hands and close
her list. You really should consult with an attorney who specializes in
electronic communications and intellectual property law who can at least
help you craft a disclaimer for your list that might shield you and your
organization from any liability.
