If you run a list freely available to the public everything on the list
is published.  If the archives are freely available to the public they
are published.

Putting the archives on a CD-ROM is merely another form of publishing.
However, it is a form of publishing not established in the ground rules
of participating in a list, unless explicitly stated.  If the CD-ROM is
going to be sold permission should be sought from each poster to the list
included on the CD-ROM and possibly royalties are due each poster.

On the other hand, if the CD-ROM is done merely as an archive backup, to
be sure of preservation, I would see no problem.  Judith and I have
certainly done the sort, Jim G. tells us he's going to dump the '91 logs,
so Judith stores them on tape and floppies, I store them on floppies, then
get Jim to put them back in after the VM > UNIX shift and all is well.
