I agree that the list owner should be aware that the list is being gated.
It seems to me to be rude to gate a list without the list owner's knowledge
and consent.  However, I'd rather (at the Netnews end) see articles with
no Newsgroups tag.  Netnews can pick up the list name off either the filename
or the tag and can then set the newsgroup to 'bit.listserv.listname'.
