The company that provides the phone could not easily be held liable
(although in the American court system, I suppose anything is possible)
because they have never been notified of the original problem.  If they
have been notified, and failed to do anything about ot, I think there
would be a strong case to argue that the phone company did not do its
proper job either, but from what I'm hearing, that is not likely here.
