Actually I figured it out however it was not very obvious. the test list did have an empty CONTENT_FILTER setup, which came up after running "GET listname MAILTPL". I didn't think or was not looking for an empty CONTENT_FILTER that would actually overwrite the global template. After deleting the list specific template the global template started working.
