Is your list set to "Send= Public"? If so, s/he does not need to be
subscribed to your list to send mail to it, and that is how s/he sent the
message without apparantly being subscribed to the list.

You could set "Send= Private" to completely exclude posts from outsiders,
or alternatively "Send= Editor" and "Editor=your_address,(FOODWINE)" to
moderate posts from non-subscribers.
Most spammers are not members of the lists or newsgroups they spam, so
that is the likely explanation.
